HNHPC, Inc. v. The Department of Cannabis Control (2023) 94 Cal. App. 5th 60 (Fourth App. Dist., Div. 3) (appeal from a trial court order sustaining the DCC's demurrer without leave to amend and the resulting judgment entered against HNHPC). On August 2, 2023, in a unanimous decision, the Court of Appeal reversed the judgment against HNHPC, finding DCC's Demurrer had been improperly sustained and that HNHPC had pled a legally viable claim for writ of mandate to compel the DCC to perform its legally mandated duty to implement a "track and trace" system which flagged irregular cannabis transactions for further investigation.
